Psilocybe-containing mushrooms are a species of fungi that possesses hallucinogenic, and mind-altering properties. These mushrooms are quite famous globally, and in the majority of the world, they are illegal or on the list of controlled substances. Some street names for these kinds of mushrooms are toppings, caps, Alice, and shrooms, but they are most commonly known as “magic mushrooms” in most parts of the world.

Although psilocybin is openly sold online and even in some storefronts in some Canadian cities, it remains illegal everywhere in Canada, including Vancouver. It does not appear that the federal government’s move to decriminalize the possession of certain controlled substances in British Columbia in 2023 will have an impact on the legal status of psilocybin there.

Are Magic Mushrooms Legal in Canada?

In the past years, magic mushrooms were illegal in Canada because they contain psilocybin which is an illicit substance. But recently, Health Canada announced the legalization of magic mushrooms for special cases. Some facilities providing a different kinds of therapies also use magic mushrooms as a part of their healing therapy.

There is a therapy called “psilocybin therapy” where the patients are given magic mushrooms in order to treat depression, anxiety, or PTSD. Some health companies in Vancouver have just recently received permits and licenses to use psilocybin in their research. They are also permitted to grow and harvest magic mushrooms and create various products solely for medicinal purposes.

However, patients are only allowed to intake psilocybin if they are diagnosed with certain mental health conditions or terminal illnesses. This practice was made possible because of the positive results noted in psychedelic therapies during the past few years.

According to the researchers, psilocybin is able to make new connections among neurotransmitters in the brain, allowing people to detach negative experiences from their emotions which can eventually lead to the treatment of conditions such as PTSD and depression.

On the other hand, there are also speculations that psilocybin-induced psychotherapy may make the patient more suggestive. This altered state of mind will allow the psychotherapist to try and help the patient make decisions, and actions in their lives in order to improve the quality of day-to-day life as well as treat various mental conditions.

Current Legal Status In Canada

Currently, psilocybin is prohibited under Schedule III of the Controlled Drugs and Substances Act (CDSA).

Psilocybin possession, cultivation, and sale are illegal throughout Canada, there are exceptions where it may be obtained and used such as in clinical trials, research, and therapy. Many people mistakenly believe (and write online) that psilocybin is legal or decriminalized in Canada because of inconsistent enforcement of the law, especially in Vancouver and British Columbia.

By the end of 2023 and 2026, personal possession of opioids, cocaine, methamphetamine, and MDMA for up to 2.5 grams will be decriminalized, but psilocybin’s legal status will remain unchanged.

Psilocybin spores are openly sold in stores across Canada, they are considered legal but only for microscopical purposes. This legality may be simply the result of non-enforcement rather than an actual substantial gap in the applicable law.
